Health and safety

Kensington Swan is the only large firm in New Zealand with a specialist health and safety team. We understand that health and safety compliance is an essential part of business, and we work closely with clients to create safe working environments that comply with statutory requirements. Our national team, headed by Grant Nicholson in our Auckland office, has an outstanding reputation for providing focussed and commercial advice on the full range of health and safety issues. Carl Reaich, in our Wellington office, has prosecuted and defended clients in complex and high profile OSH prosecutions throughout the country. Our national team also provides pro-active support to employers by reviewing and advising on their systems and processes, with a view to ensuring that they can comply with their obligations as practically and cost effectively as possible.

Construction

Our national construction team is involved in a wide range of projects, both in New Zealand and overseas. These include major infrastructure projects, roading contracts, energy projects, hospitals, prisons, shopping centres, and commercial, industrial and residential developments including leaky homes. Our team advises clients at every stage of the project from procurement, contract structures and risk management through contract administration, claims, and dispute resolution. We act for large international construction companies, as well as small and medium-sized contractors, owners and consultants, local authorities, and Government and industry organisations. Being members of several industry-related organisations, including the New Zealand Contractors' Federation and the New Zealand Council of Infrastructure Development, enables us to keep up with trends and best practice.

Debt collection

Kensington Swan offers a cost effective debt recovery service for all debts.

Key features of its debt recovery service are:

  • set fees for each step taken so you always know the costs of each action in advance;
  • the debtor receives a letter of demand or court proceedings within 24 hours of your instruction;
  • this first contact, in the majority of cases, makes the debtor offer to pay some or all of the debt;
  • twenty-four hour implementation of all subsequent instructions. This quick and efficient turnaround puts pressure on debtors and encourages the early settlement of claims;
  • the high level of net returns produced, even on smaller debts, makes it unique; and
  • debt collection agencies charge normal legal fees and then charge a hefty commission as well. Kensington Swan charges only a modest set fee for each step and NO commission.

Our team specialises in dealing with employment issues arising out of dispute resolution and litigation, commercial transactions, restructures, redundancy, collective bargaining, strikes and lockouts, personal grievances, disciplinary and termination procedures, legislative compliance, Holidays Act, privacy and human rights.

We also provide advocacy at all levels from mediation, to the Employment Relations Authority, and through to the Supreme Court. Our team works alongside a specialist Heath and Safety team to provide strategic, compliance and advocacy services specific to health and safety in employment law.
